Executors and solicitors

We know that being an executor can sometimes feel daunting. You may find the information below useful, whether you are a professional executor or a layperson.

 Siobhan…

'They give to you the one thing that's taken away from you at diagnosis, and that's hope. It's hope for a better life, it's hope for a better future, it's support that you need, and I can't stress enough how invaluable that is to somebody in the predicament.'

Is the legacy for Macmillan?

If you are not sure whether the charity named in the Will is Macmillan or not, please check our list of previous names and addresses [PDF, 24kb]. If you are still not sure, please contact the Legacy department for advice.

The Will says 'Macmillan Nurses', are you the same
 charity?

'Macmillan Nurses' is not a separate charity, but is a service run by Macmillan Cancer Support.  We dedicate all legacies for 'Macmillan Nurses' to our nursing service.

How should I pay a legacy?

All legacies are administered from our registered office at 89 Albert Embankment, London SE1 7UQ.  You can send a cheque made payable to 'Macmillan Cancer Support' to the Legacies Department at this address.  Please contact us if you would prefer to make payment by BACS.

What information do you require?

This will depend on the type of legacy, so please contact us.  If you are able to supply a copy of the Will, this will enable us to be as specific and accurate as possible.

Can you collect a legacy of personal belongings?

Macmillan doesn't have any charity shops so we unfortunately cannot accept gifts of personal belongings directly in most circumstances.  However, we are always delighted to receive any proceeds of sale, and if you think any items may be valuable, we can arrange valuations and special rates with some of the country's best-known auction houses.

What should I do if the legacy is a property or shares?

We are able to provide a great deal of support and advice if you are dealing with a property or shares, including preferential rates of commission on sales and advice on tax.  Please let us know the nature of a bequest, with a valuation if applicable, and we can work with you to make sure the maximum value is achieved.

What about tax?

Macmillan as a registered charity enjoys exemptions from Inheritance Tax, Capital Gains Tax and Income Tax, and there are many ways in which tax can be saved during the administration of an estate to make a legacy worth even more to the charity.

Even professional executors are not always aware of the most tax efficient methods of administration, so please do contact us as early as you can so that we can help with this.
